Don’t tread on Texans’ gun rights, Abbott says in plan to ‘protect’ Second Amendment Gov. Greg Abbott, for one, is focused on making Texas a “Second Amendment sanctuary state.” “Politicians from the federal level to the local level have shouted: ‘Heck yes, the government is coming to get your guns,’” Abbott said, referencing Beto O’Rourke’s remarks during his 2020 Democratic bid for president when he said: “Hell yes, we’re going to take your AR-15, your AK-47.” Ammo shortage not expected to end any time soon 2020 proved to be a record year for firearm purchases, according to the National Shooting Sports Foundation with millions of people buying guns for the first time. Now many of those gun owners are running into an ammunition shortage. MISSOURI COUNTY PASSES ORDINANCE CALLING FOR ARREST OF FEDS WHO ENFORCE UNCONSTITUTIONAL GUN LAWS — THIS IS HOW YOU DO IT The Newton County Commission passed an ordinance Feb. 3 that both blocks the implementation of unconstitutional federal gun control laws but also makes it a crime to try to enforce them. Attacks on Second Amendment Trigger Tyranny The election swept in a legion of Second Amendment foes. Americans can expect them to take James Madison’s statement that disarming the people is “the best and most effective way to enslave them” as less of a warning and more of a directive.

There have been many new gun bills introduced this legislative session.  Below is a summary of the Good, Bad and Ugly. Good H.R. 95 - Hearing Protection Act  -  This bill removes silencers from the definition of firearms for the purpose of the National Firearms Act. H.R. 38 - Concealed Carry Reciprocity - This bill establishes a federal statutory framework to regulate the carry or possession of concealed firearms across state lines. Specifically, an individual who is eligible to carry a concealed firearm in one state may carry or possess a concealed handgun (other than a machine gun or destructive device) in another state that allows its residents to carry concealed firearms. H.R. 993 - Second Amendment Preservation Act - Cut all federal funding from implementing, enforcing or advancing any measure, law, regulation, or guidance relating to the unlawful use purchase, sale, possession or transportation of firearms. Bad H.R. 130 - Kimberly Vaughan Firearm Safe Storage Act - To require the safe storage of firearms and ammunition, and to require the investigation of reports of improper storage of firearms or ammunition. H.R. 125 - Gun Safety, Not Sorry - To amend title 18, United States Code, to provide for a 7-day waiting period before a semiautomatic firearm, a silencer, armor piercing ammunition, or a large capacity ammunition magazine may be transferred. H.R. 121 Gun Violence Reduction Resources Act - This bill authorizes the Department of Justice to hire 200 additional agents and investigators for the Bureau of Alcohol, Tobacco, Firearms and Explosives. H.R. 167 - Prohibition on Transfer of Firearms at a Gun Show - To prohibit the transfer of a firearm at a gun show by a person who is not a federally licensed firearms dealer. H.R. 30 Gun Trafficking Prohibition Act - To increase public safety by punishing and deterring firearms trafficking. Ugly H.R. 127 Sabika Sheikh Firearm Licensing and Registration Act - To provide for the licensing of firearm and ammunition possession and the registration of firearms, and to prohibit the possession of certain ammunition.

Do You Want Your Ex-Spouse Determining Whether You Can Own a Firearm?

 

Do you want your ex-spouse to be able to dictate whether you are eligible to own a firearm? Or, do you want your neighbors, employer, law enforcement, or criminals knowing what firearms you own?  Texas Representative Sheila Jackson Lee (D-Houston) thinks these two ideas are good. Representative Jackson Lee has introduced H.R. 127 which would enact some of the strictest and draconian gun regulations in history. Here are the key points of the bill. Creation of a National Firearm Registry that includes make, model, serial number, identity of the owner, the date the firearm was acquired and where it is stored. The registry will be made accessible to all member of the public, all Federal, State and local law enforcement, all branches of the armed forces and all State and local governments. Creation of national licensing requirements. In order to be licensed the following must occur: Must be 21 years of age. Undergo a criminal back ground check. Undergo a psychological evaluation that is done by a psychologist approved by the government. Also a psychological evaluation will be done of other members of the household. As part of the psychological evaluation the psychologist interviews any spouse, any former spouse and at least 2 other persons who are members of the family or an associated of the individual. Successfully complete a training course. Purchase an insurance policy that insures the person against liability. If you fail to get a license or register a firearm, the fine is not less than $75,000 and not more than $150,000, and you will face at least 15 years but no more than 25 years in jail. I believe this is the epitome of what our founders meant when they said "shall not be infringed." If this doesn't "infringe" on our right to bear arms, I'm not sure what does.

Constitutional Carry and Other New Legislation Proposals.

 

With 21 million guns sold in 2020 (over 8 million first time buyers) and a democrat-controlled federal government, gun legislation will become a significant topic in 2021. Last week, we talked about a move by Texas to become a 2nd Amendment sanctuary state, and now let's talk about some of the other potential legislation. Constitutional Carry, the ability of someone's ability to carry a handgun without a permit, is again proposed in several states. Sixteen states currently have Constitutional Carry. In Texas, Kyle Biedermann (R-Fredericksburg) introduced HB 1238 which will allow anyone eligible to possess a handgun to also carry it concealed. Senator Bob Hall (R-Edgewood) introduced SJR 24, which proposes an amendment to the Texas Constitution that prohibits the state from requiring a citizen "to obtain a license or permit to wear arms." Utah, Montana, Tennessee, South Carolina, Florida, Indiana, Alabama and Georgia have also had bills introduced proposing Constitutional Carry. Other firearm-related bills introduced into the Texas legislature include: HB 1379 - Raises the cap on establishments where carrying a firearm is prohibited based on alcohol sales of 51% to 60 percent. HB 514 - Eliminates schools from the list of gun-free zones in Texas code. HB 918 - Allows 18-21 year olds who are protected under court orders to apply for a License to Carry. HB 1094 - Expands on HB 918 and allows those individuals to carry without a permit. Go here for a list of current Texas bills related to firearms.
