On Monday, the Supreme Court decided to hear the first 2A case in over a decade. New York State Rifle & Pistol Association Inc. v. Corlett is now being considered by the SCOTUS. This case challenges New York’s requirement for applicants to demonstrate “proper cause” to carry a firearm. To meet "proper cause" requires the applicant to demonstrate an immediate threat such as death threats, evidence of being followed or a recent attack. New York regularly uses this requirement to deny applicants. In practice, the only people who are awarded a license are the elite and well connected. It is argued that New York’s practice is unconstitutional because the Second Amendment “guarantees rights to ‘keep and bear arms’ to all the people,’” not just to the select few that the state deems worthy. The decision to hear the case has triggered the Left, and they are going crazy. Hannah Shearer, Litigation Director at the Giffords Law Center, was not pleased. “The Supreme Court’s willingness to take up this case is a reckless response to our nation’s grief and could take us in the completely wrong direction by restricting common sense gun safety regulation,” Shearer said in a statement. “Today’s announcement is a warning sign that our nation’s highest court is poised to brush aside the will of the people and instead side with gun lobby groups seeking to eliminate even the most modest firearm laws.” Everytown for Gun Safety, the largest gun-control group in America, agreed the stakes in the case are “particularly high now” and predicted disaster if the court sides with the plaintiffs. “Gun violence has only worsened during the pandemic, and a ruling that opened the door to weakening our gun laws could make it even harder for cities and states to grapple with this public health crisis,” said Eric Tirschwell, Managing Director of Everytown Law. In an article on vox.com, they stated, "The future of gun control in the United States could be quite grim — and Corlett could mark the moment when lawmakers’ power to fight gun violence falls apart. Mayor Bill de Blasio said “my heart sank” when he heard about the Supreme Court’s review. “We’ve come so far to try to keep guns out of the hands of New Yorkers, particularly young people, and the Supreme Court, it looks like they’re working overtime to put guns right back in those hands,” de Blasio said Monday. “That really worries me. The mayor said the quiet part out loud when he stated they were trying to keep guns out of the hands of New Yorkers. I guess he hasn't read the part of the 2nd Amendment that says "shall not be infringed." |
